Financial benefits granted to the petitioners by resolution of respondent No.3 Society has been withdrawn by the Registrar, in the exercise of power under Section 27 of the Haryana Cooperative Societies Act, 1984 (for short ‘the Act’). An appeal is stated to be pending before the Appellate Authority- respondent No.1.

Through instant petition, the petitioners seek a direction to respondent No.1 to consider the claim of the petitioner for interim relief

under Section 116 of the Act. Counsel for the petitioners submits that the appeal is fixed before respondent No.1 for December 12, 2013.

This petition is disposed of as premature and not maintainable as the alternative remedy has already been availed of by the petitioners. The appeal being a statutory right of the petitioners under the Act and a provision for interim relief having been incorporated under the statute under Section 116 of the Act. It is directed that an application annexure P-3 will be decided on December 12, 2013, the date fixed for appeal or within a period of 15 days after December 12, 2013. It is ordered that the status quo regarding the allowances being paid to the petitioners before the impugned order dated May 15, 2013 will be maintained till December 12, 2013.
