An additional affidavit of Executive Engineer, HUDA, Division No.1, Faridabad has been placed on record to the effect that in compliance with the order dated September 6, 2011 passed by this Court, the development work i.e. road, water supply and sewer has been provided by the office of the deponent in front of the plot i.e. Industrial plot No. 91, Sector 51 Part II, Faridabad. The service road has finally been completed.

Counsel for the petitioner submits that despite all the steps having been taken by the respondent, the petitioner is not able to raise construction on the alternative plot allotted on account of certain electric poles.

The petitioner appears to have alternative remedy for shifting all the poles by approaching the competent authority. The petitioner may avail the said remedy for which the respondent is expected to cooperate.

This petition is disposed of as having been rendered infructuous at this stage with liberty to the petitioner to revive the same in case of any grievance in context to the plot being not fully developed as per the assurance given vide order dated May 29, 2010.
