Nanti Devi & Anr. Vs State of Haryana & Ors.

Petitioners have preferred this writ petition for issuance of a writ in the nature of Mandamus directing the respondents to release the Death-cum-retirement gratuity of Late Sh.Risal Singh, including family pension, gratuity, leave encashment alongwith arrears with all consequential benefits.

The petitioners have sent a legal notice annexure P-5 dated July 18, 2013 to the Chairman and Secretary, Haryana Board of School Education, Bhiwani for the same relief.

Without expression of any opinion on merits of the case, I deem it appropriate to dispose of this writ petition at this stage with a direction to the Secretary, Haryana Board of School Education, Bhiwani to consider the legal notice dated July 18, 2013, annexure P-5 within a period of three months after the receipt of certified copy of the order by passing a speaking order. It will be the duty of the petitioners to communicate the order passed by this Court to the Secretary of the Board. Ordered accordingly.
