This order will dispose of two contempt petitions filed by Amar Singh and another (COCP No. 1056 of 2013) and Balkar singh (COCP 2018 of 2013).
The petitioners in both the cases are Agriculture Sub Inspectors, claiming that the said post is equated with Surveyors and that the petitioners had not been granted senior scale on completion of 12 years of service, as such, they had filed writ petition. The writ petition was disposed of with a direction that the writ petition will be treated as representation and final decision will be taken by passing a speaking order within four months from the date of receipt of a certified copy of the order.
Claiming that the orders passed by this court had not been complied with, the present contempt petitions have been filed.
In the reply filed in COCP 2018 of 2013, it has been submitted that the claim of the petitioners has been considered and a speaking order dated 26.3.2013 (Annexure R-1) has been passed rejecting the claim of the petitioner on a number of grounds, mentioned therein.
Both the petitions are disposed of as having rendered infructuous without prejudice to the rights of the petitioners to challenge the legality and propriety of order Annexure R-1 before the Commission meant for the purpose or avail any other legal remedy, in accordance with law.
