Learned counsel for the petitioner would submit that the application of the petitioner seeking appointment on compassionate basis had been under active consideration with the respondentAuthority and in terms of memo dated 09.02.2000 (Annexure P-7), the Regional Employment Officer, Chandigarh had informed the petitioner that her name had been recommended for appointment to Class-IV post to the Director Transport, C.T.U., Chandigarh. Counsel would even refer to memo dated 27.08.2002 (Annexure P-12) whereby the petitioner had been called to attend a meeting in the office of the Divisional Manager, C.T.U. and Director Transport, U.T., Chandigarh in relation to her claim seeking compassionate appointment. Counsel would contend that the impugned order dated 26.09.2005 (Annexure P-13) had never been conveyed to the petitioner and it was only in the month of September, 2011 when she had visited the office of the General Manager that a member of the clerical staff had handed over a photocopy of the same.
