With the consent of learned counsel for the parties the main writ petition which stands admitted is taken up on the board today itself for final disposal. Documents at Annexures A-1 to A-7 are taken on record.

The instant writ petition has been filed by the petitioners, who are working on the post of Constable Pharmacist with the Haryana Police for the grant of pay scale of Rs.5,000-7850 with effect from their initial dates of appointment. Such claim had been raised in the light of a decision taken by the State Govt. vide memo dated 5.6.1995 (Annexure A-1).

Learned counsel for the petitioner would refer to the document at Annexure A-1 dated 5.6.1995 issued from the office of Financial Commissioner & Secretary to Govt. of Haryana, Finance Department and addressed to the Director General of Police, Haryana on the subject of revision of pay scales of Pharmacist of Home (Police Department). of such letter, it is apparent that the State Govt. has taken a decision to revise the scale of Pharmacists of the Police Department, Haryana from Rs.750-940 to Rs.1400-2600 w.e.f. 1.4.1995. Learned counsel appearing for the petitioners would urge that the dates of appointment of all the petitioners is after 1.4.1995 and the scale claimed in the writ petition i.e. Rs.5,000-7850 is the further revised scale from Rs.1400-2600. Counsel would argue that in the light of such decision at Annexure A-1, the claim of the petitioners would be squarely covered in their favour. It has also been urged that identically situated employees holding the post of Constable Pharmacist under the Police Department have already been granted the pay scale of Rs.5,000-7850 as is being claimed by the present petitioners.

Learned State counsel has very fairly conceded that in the light of order dated 5.6.1995 at Annexure A-1 the claim of the petitioners as raised in the present writ petition is covered and deserves to be allowed.

Accordingly, the present writ petition is allowed. It is directed that the petitioners be granted the pay scale of Rs.5,000-7850 with effect from their initial dates of appointment on the post of Constable Pharmacist. The consequential arrears be also calculated and released to the petitioners within a period of three months from the date of receipt of a certified copy of this order.
