The petitioners have been granted promotion to the post of Principal (Haryana Education Service) Class-II vide order dated 24.04.2012 (Annexure P-5).

The grievance raised in the present writ petition is with regard to claiming such benefit of promotion w.e.f. the date a junior to them i.e. Sh. Kundan Kalra had been so promoted i.e. w.e.f. 21.07.2007.

Counsel for the petitioners would argue that earlier in point of time, a tentative seniority list of Lecturers (School Cadre) had been circulated, in which, the petitioners had been shown junior to the aforesaid Sh. Kundan Kalra. Objections had been submitted and in terms of issuance of final seniority list of Lecturers at annexure P-3 on

CWP No. 1795 of 2013 -2- 01.10.2011, the seniority position has been re-drawn and now the petitioners have been shown senior to Sh. Kundan Kalra. It is on such basis that the petitioners are also seeking benefit of ante dated promotion to the post of Principal w.e.f. 21.07.2007.

The present writ petition is disposed of in terms of granting liberty to the petitioners to file a detailed representation as regards their claim seeking promotion w.e.f. 21.07.2007 to the post of Principal. In the eventuality of any such representation being filed, it shall be obligatory upon the respondent-authorities to consider the same strictly in accordance with law and and in terms of passing a final order thereupon within a period of three months from the date of submission of the same.
