Petitioner is seeking interest on retiral benefits, which have been released to him after an inordinate delay.

Putting forth his claim, petitioner has served a legal notice dated 3.10.2012 (Annexure P-6) upon the respondents, wherein interest was also claimed along with the retiral benefits, but the interest component has not been responded to. Only the retiral benefits have been released.

Counsel contends that the petitioner, at this stage, would be satisfied if a direction is issued to respondent Nos.3 and 4, i.e., District Education Officer (S.E.), Bathinda and Principal, Des Raj Memorial Government Senior Secondary School, Bathinda to consider and decide the claim of the petitioner of interest on delayed

payment of the retiral benefits at an early date.

In view of the statement made by the counsel for the petitioner and without going into the merit of the case or commenting thereon, the present writ petition is disposed of with directions to respondent Nos.3 and 4, i.e., District Education Officer (S.E.), Bathinda and Principal, Des Raj Memorial Government Senior Secondary School, Bathinda to consider and decide the legal notice dated 3.10.2012 (Annexure P-6) served by the petitioner within a period of two months from the date of receipt of certified copy of this order.

In case the claim of the petitioner is accepted, the consequential benefits, if any, be released to him, in accordance with law, within a further period of one month.

In case the claim of the petitioner is not to be accepted, then a well reasoned and speaking order be passed and conveyed to the petitioner forthwith.
