The State of Punjab, Department of Education, issued instructions dated 26.09.2001 (Annexure P-1), whereby, a decision was taken that in the Masters/Mistresses Cadre, 1% quota shall be earmarked to be filled up by way of promotion from the Ministerial/Non-Teaching Staff. The petitioners are working on the posts of Clerks. The grievance of the petitioners is that they are not being considered as regards promotion to the higher post in the Master Cadre against the 1% quota despite of posts lying vacant. In this regard, learned counsel appearing for the petitioners would refer to Memo dated 25.08.2010 (Annexure P-5) whereby information was supplied under the provisions of Right to Information Act stating that there was a total of 419 posts of Master Cadre in relation to the 1% quota for non-teaching staff in the Master Cadre and after having

made promotions, 172 posts are still lying vacant. Counsel for the petitioners submits that cases of the petitioners have been forwarded to higher authorities vide Annexures P-6 and P-7 dated 18.10.2011 and 08.04.2013.

In the light of the averments made in the petition, I deem it appropriate to dispose of the present writ petition with directions to the respondent/authorities to decide the claims of the petitioners as forwarded vide Annexures P-6 and P-7 strictly in accordance with law and by passing a speaking order within a period of four months from the date of receipt of certified copy of this order.
