Petitioner has approached this Court with a grievance that the retiral benefits have not been released to him.

It is asserted that he retired as a Sub-Divisional Engineer from the Construction Division No.1, P.W.D.(B&R), Garhshankar, District Hoshiarpur on 30.4.2007. Because of non-availability of the service took/some missing entries in the service book, retiral benefits have not been released to the petitioner till date, except leave encashment. That benefit has also been released to him after an inordinate delay. Petitioner had been approaching the respondents with requests for release of his retiral benefits, but without any result. Petitioner has submitted a representation dated 1.5.2013 (Annexure P-5) to the Chief Engineer, P.W.D, B&R, Branch- respondent No.2 for release of his pensionary benefits, which has, till date, not been responded to.

Counsel contends that the petitioner, at this stage, would be satisfied if a direction is issued to respondent Nos.2 to 4, i.e., Chief Engineer, PWD, B&R, Branch, Superintending Engineer, Ferozepur Circle, P.W.D., B&R and the Executive Engineer, Construction Division No.2, P.W.D., B&R, Hoshiarpur to consider and decide the representation dated 1.5.2013 (Annexure P-5) filed by the petitioner, within some specified time.

In view of the statement made by the counsel for the petitioner and without going into the merit of the case or commenting thereon, the present writ petition is disposed of with directions to respondent Nos.2 to 4, i.e., Chief Engineer, PWD, B&R, Branch, Superintending Engineer, Ferozepur Circle, P.W.D., B&R and the Executive Engineer, Construction Division No.2, P.W.D., B&R, Hoshiarpur to consider and decide the representation dated 1.5.2013 (Annexure P-5) within a period of two months from the date of receipt of certified copy of this order.

In case the claim of the petitioner is accepted, the consequential benefits, if any, be released to him, in accordance with law, within a further period of one month.

In case the claim of the petitioner is not to be accepted, then a well reasoned and speaking order be passed and conveyed to the petitioner forthwith.
