Laxmi and Anr. Vs State of Punjab and Ors.

Petitioners seek protection of their life and liberty claiming that they have attained majority and married against the wishes of their family members. The factum of marriage has been disputed by father of petitioner No.1. Without expression of opinion on the validity of marriage, taking into consideration the constitutional right of the petitioners, they can be granted protection in the capacity as citizens of India, if not as married couple.

In view of the above said facts and circumstances, the interim order dated 7.11.2012 is hereby made absolute without expression of any opinion regarding validity of marriage. It is open to the private respondents to challenge the validity of the marriage but no force will be used by any of the respondents to curtail the life and liberty of the petitioners.
