This order will dispose of two petitions bearing CRM M-35265 of 2012 and CRM M-5942 of 2013, filed by Dev Raj Poswal and Jagdish Parshad, for grant of pre-arrest bail in a case of cheating registered at the instance of Sunil Kumar alleging that he was interested in purchasing a plot and the petitioner Dev Raj Poswal gave him a clue that he is aware of a plot which was for sale and the same could be shown to the complainant as construction work was going on. The petitioner had taken complainant Sunil Kumar to Jagdish Parshad where Sunder and Jagdev were found present. They showed him land measuring 220 sq. yards being part of 16 kanals 0 marlas where the construction work was going on. Jagdish Parshad told the complainant that he had entered into an agreement of sale of said plot with Ajit Singh and had executed an agreement of sale. On the basis of said agreement of sale Ajit Singh had executed agreement of sale in favour of Dev Raj Poswal-petitioner, on June 1, 2011. The complainant required that Ajit Singh should be called. All the accused persons called Ajit Singh and the complainant was persuaded to purchase the plot as there was no legal impediment telling him that the plot was free from all encumbrances. Believing Dev Raj Poswal, Jagdish Parshad , Ajit Singh, Sunder and Jagdev, the complainant entered into an agreement of sale of the plot for Rs.23 lacs.
