Prayer in this petition is for grant of regular bail to petitioner Ramkanwar @ Ram Kumar, who has been booked for having committed the offence punishable under Section 306 read with Section 34, IPC, in a case arising out of FIR No.220, dated 05.06.2013, registered at Police Station, Sadar, Sonepat.

Learned counsel contends that son-in-law (damad) of the petitioner committed suicide and the petitioner has been falsely been implicated for commission of the offence punishable under Section 306, IPC; that earlier the petitioner approached the Court for grant of anticipatory bail and the said petition was dismissed at that stage; that the petitioner is behind the bars from 05.07.2013; and that after completion of the investigation, the charge-sheet (report under Section 173, Cr.P.C.) has already been filed, therefore, further incarceration of the petitioner in the present case is not required.

Learned counsel for the State, on instructions from ASI Ramesh Chander, Police Station, Sadar, Sonepat, submits that the main thrust of allegations are against the petitioner with regard to

putting pressure on the deceased to transfer half of the property in favour of his daughter (wife of the deceased) at different stages. He further submits that after completion of the investigation, the chargesheet (report under Section 173, Cr.P.C.) has already been submitted before the learned Area Judicial Magistrate. However, he concedes that the veracity of the suicide note allegedly left behind by the deceased, is yet to be tested by the govt. handwriting expert at Madhuban.

I have heard the learned counsel for the parties and with their able assistance gone through the material available on record.

Concededly, after investigation, the charge-sheet (report under Section 173, Cr.P.C.) has been filed. The petitioner who is the father-in-law of the deceased, is behind the bars from 05.07.2013. The veracity of the suicide note left behind by the deceased is yet to be tested by the govt. handwriting expert. The similar situate coaccused have already been granted bail by the courts of competent jurisdiction. The trial would take sufficient long time. The petitioner is neither required nor involved in any other case.

Keeping in view the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner-Ramkanwar @ Ram Kumar s/o Chandgi Ram, r/o village Bidhlan, Tehsil Kharkoda, District Sonepat, is ordered to be released on bail during the pendency of the trial of the present case subject to his furnishing bail bonds to the satisfaction of the learned Chief Judicial Magistrate/Duty Magistrate, Sonepat.
