Prayer in this petition is for grant of regular bail to petitioner Baljit Singh @ Gogie who has been booked for having committed the offences punishable under Sections 382, 411, 412, 454 read with Section 34, IPC, and Section 25 of the Arms Act, in a case arising out of FIR No.51, dated 14.12.2012, registered at Police Station, Mehal Kalan, District Barnala.

Learned counsel contends that even if the whole case of the prosecution is taken at its face value, then also the ingredients of the offences for which the petitioner has been booked, are not made out; that similar situate co-accused, namely, Kulwinder Singh @ Kinder, has been granted bail by this Court vide order dated 26.09.2013, passed in CRM-M-25272 of 2013; and that the petitioner is behind the bars from 10.05.2013.

Criminal Misc.No.M-32673 of 2013 {2} Jasbir Singh, Police Station, Mehal Kalan, District Barnala, very fairly concedes that the petitioner is neither required nor involved in any other case. It has also been conceded that the petitioner is behind the bars from 10.05.2013.

I have heard the learned counsel for the parties and gone through the material available on record.

The similar situate co-accused, namely, Kulwinder Singh @ Kinder, was granted bail by this Court vide order dated 26.08.2013. The case of the petitioner is on the same pedestal. The petitioner is behind the bars from 10.05.2013. After completion of the investigation, the charge-sheet (report under Section 173, Cr.P.C.) has already been presented.

Keeping in view the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner-Baljit Singh @ Gogie son of Davinder Singh, r/o village Chappa, District Barnala, is ordered to be released on bail during the pendency of the trial of the present case subject to his furnishing bail bonds to the satisfaction of the learned Chief Judicial Magistrate/Duty Magistrate, Barnala.
