Prayer in this petition is for grant of regular bail to petitioner Manjeet who has been booked for having committed the offences punishable under Sections 302 and 307 read with Section 34, IPC, and Sections 25 and 27 of the Arms Act, in a case arising out of FIR No.324, dated 02.08.2011, registered at Police Station, Sadar, Bahadurgarh, District Jhajjar.

Learned counsel contends that though it is a case of double murder but the only role assigned to the petitioner is that of catching hold of one of the deceased, namely, Ravi; that it was unusual that a person who is likely to be shot dead would be caught by another accused, therefore, it was improbable that the petitioner would hold Ravi while he was being shot dead by means of firearm by another person; that the prosecution has been granted numerous opportunities by the learned trial court for leading its evidence but only two formal witnesses have been produced so far; that the petitioner is behind the bars from 03.08.2011 and the trial is not likely

Learned counsel for the State, on instructions from SI Ravi Kumar, Police Station, Bahadurgarh, District Jhajjar, very fairly concedes that the petitioner has been assigned the role of catching hold of one the deceased, namely, Ravi. He further concedes that the petitioner is behind the bars from 03.08.2011 and out of 27 prosecution witnesses, only two have been examined.

I have heard the learned counsel for the parties and with their able assistance gone through the material available on record.

Concededly, the petitioner has been assigned the role of catching hold of one of the deceased, namely, Ravi, who was shot dead by means of a firearm by his co-accused. The petitioner has already suffered incarceration of two years and three months. In spite of several opportunities granted to the prosecution, only two prosecution witnesses have been examined. The trial would taken sufficient long time to conclude. The main accused who used the firearm to commit murder are behind the bars.

Keeping in view the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner-Manjeet son of Risal Singh, r/o village Jassuar Kheri, Tehsil Bahadurgarh, District Jhajjar, is ordered to be released on bail during the pendency of the trial of the present case subject to his furnishing bail bonds to the satisfaction of the learned Chief Judicial Magistrate/Duty Magistrate, Jhajjar.
