The petitioner seeks the concession of regular bail in a case of recovery of 15 kgs of opium. The petitioner was arrested on 18.7.2007 but on 10.9.2007 he escaped from the custody and was re-arrested on 31.12.2009. The petitioner being remained in custody for a period of about 3 years, could have been granted the concession of bail but in view of the fact that only one prosecution witness remains to be examined, it will not be prudent to consider the bail application in context to the evidence led, lest it should prejudice the right of the petitioner or the prosecution. It is deemed appropriate in the interest of justice to decline bail to the petitioner at this stage, however, requiring the trial court to expeditiously dispose of the trial by giving a fair opportunity to the petitioner to lead evidence. The petition is dismissed with liberty to the petitioner to approach this court again in case the trial is not concluded within six months after a receipt of a copy of this order.
