Nafe Singh and Ors. Vs State of Haryana and Ors.

The petitioners by way of present writ petition filed under Articles 226/227 of the Constitution of India has sought for issuance of a writ of mandamus for directions to the respondents to allot the plots to the petitioners measuring 100 Sq. Yds. for residence of the petitioners as they belong to Scheduled Castes/B.C./BPL Classes of category.

Learned counsel for the petitioners submitted that a representation dated 15.12.2010 (Annexure P-2) has been submitted by the petitioners to respondent No.3. He stated that the petitioners would be satisfied, in case, a direction is issued to respondent No.3 to decide the said representation (Annexure P-2) after affording an opportunity of hearing to the concerned parties.

Learned counsel for the respondents have no objection for the same.

Accordingly, the present writ petition is disposed of by directing respondent No.3 to take a decision on the representation (Annexure P-2) by passing a speaking order in accordance with law after hearing concerned parties within a period of three months from the date of receipt of certified copy of this order.
