the marriage had been dissolved. Thereafter, one of the family friends of petitioner No.2 introduced him with the family of petitioner No.1 and the marriage of the parties was settled which was solemnised on 12.12.2007 at Gurdwara Singh Sabha, Hiala, District Nawan Shahar. The marriage was got registered vide application dated 19.11.2008 and the certificate of registration of marriage is at Annexure P.1. According to the petitioners, there was communication gap between the counsel in Canada and petitioner No.2. Infact, the terms and conditions of divorce had been settled but the final decree of divorce in relation to marriage of petitioner No.2 with Parminder Kaur was not passed by the Court. The decree of divorce was infact passed by the competent Court in Canada on 6.10.2008, Annexure P.2. The petitioners are living as husband and wife with effect from 12.12.2007 till date. The marriage of the petitioners was registered on 20.11.2008 i.e. after the passing of the final decree dated 6.10.2008. The petitioners are now facing difficulty in getting the Visa as the present marriage had been solemnised before the passing of the final decree of divorce in respect of earlier marriage of petitioner No.2 with Parminder Kaur. The petitioners filed an application dated 26.4.2010, Annexure P.3 before respondent No.2 for cancellation of the marriage certificate. Having received no response, the petitioners have filed the present petition.
