Petitioners have approached this Court impugning the order dated 17.10.2002, vide which the claim of the petitioners for regularization of their services, has been rejected.

During the course of hearing on 22.5.2012, petitioners had submitted that persons, who were similarly employed as the petitioners and subsequent to the petitioners, have been regularized, whereas the claim of the petitioners has neither been considered nor have they been granted the benefits as the persons who are junior to the petitioners as they are appointed subsequent to the petitioners, has been released.

Today, counsel for the petitioners has again sought time to file such an affidavit. Keeping in view the submission made by the counsel for the petitioners, the Court is of the opinion that the interest of justice would be duly served by granting liberty to the petitioners to file a detailed

representation to the Senior Superintendent of Post Offices, Patialarespondent No. 2 within a period of four weeks from today, claiming the benefit of regularization on the basis of similar claim granted to the persons allegedly junior to the petitioners.

If such a representation is made by the petitioners, the same shall be considered and decided by the Senior Superintendent of Post Offices, Patiala-respondent No. 2 with a period of three months of such submission of the representation. The decision, so taken, be conveyed to the petitioners forthwith. In case, the claim of the petitioners is accepted, the consequential benefits, if any, shall be released to the petitioners within a further period of four weeks.

Counsel for the petitioners has stated that Smt. Rani wife of Shri Amar Nath-petitioner No. 2 has since expired. He prays to file representation on her behalf through the legal representatives of petitioner No. 2.

Prayer granted as prayed for by counsel for the petitioners.

The interim order granted in favour of the petitioners shall continue till the final decision on the representation of the petitioners. The application as well as the writ petition stands disposed of accordingly.
