16.11.2010, Annexure P.2 intimated that the Government of India had allowed the up-gradation for the balance quantity of paddy crop 2009-10 at the rate of Rs.100/- per quintal in various districts of the State of Punjab including Patiala. The FCI vide letter dated 25.11.2010, Annexure P.3 introduced a certificate for upgradation and its cost to be taken from the State Agencies of Punjab at the time of delivery of CMR. As per the certificate, it was the District Manager who was to certify that after up-gradation, the CMR was within the relaxed specifications applicable for KMS 2009-10. It was also provided that if the information was incorrect, the agency would be liable for refunding the up-gradation charges to the FCI. The said decision was communicated vide letter dated 26.11.2010, Annexure P.4. Thereafter, a meeting of the District heads of the Punjab Government agencies of Patiala was held on 21.3.2011, Annexure P.5 regarding the issuance of the certificate and it was decided that undertakings be obtained from the concerned millers in respect of replacement of the stocks. The petitioner brought these proceedings to the notice of the Managing Director. Despite repeated requests of the petitioner for the necessary clarifications in respect of which documents are to be taken from the millers so that expenses incurred on the upgradation of the CMR by the millers can be authenticated and only then the payment can be sought from the FCI for onward transmission to the millers, no guidelines are being framed in respect of the certification of the expenditure incurred on the upgradation of CMR. Hence this petition.
