This writ petition was adjourned sine die to await judgment in CWP No.14814 of 2007 vide order dated October 4,2008.
After the decision of the said writ petition, registry has put up this case for hearing. Notice of the date was issued to the Counsel for the petitioner but despite service of the notice by this Court, on the Counsel, none has put in appearance on behalf of the petitioner despite the case having been called twice.

V. Union of India and others it comes out that this Court had dismissed the writ petition finding no merit therein. This explains the non-appearance on the part of the Counsel for the petitioner.
In the light of the Division Bench judgment passed by this Court in CWP 14814 of 2007 titled J.L. Sharma and others V. Union of India and others decided on 6.3.2009, the present writ petition is dismissed on the same grounds and on same terms.
