being single tender, name of the petitioner was declared as a successful bidder. The respondent could hold the tender for a period of 90 days and the petitioner was not allowed to act upon being a successful and sole bidder for the above said tender. The respondent sent a letter to the petitioner and sought the extension of one month after completion of 90 days and was called for negotiation. Thereafter, the petitioner received a letter dated 17.7.2012 (Annexure P-3) from the respondent for extension of time of one month upto 17.8.2012. The respondent issued notification of the tenders dated 26.7.2012 and fixed the date of opening of the tender as 28.8.2012. Vide the said tender notice, Annexure P-4, the reserve price for 4-Ton per day was fixed at ` 21,994/-. The petitioner served a legal notice dated 9.8.2012 (Annexure P-6) which was not replied by the respondent. The respondent issued a corrigendum on 7.9.2012 in reference to the notice dated 26.7.2012 for leasing of SLR/AGC in various mail express and ordinary passenger trains for a period of three years which were to be opened on 28.8.2012 and 6.9.2012 and changed the dates. The respondent without deciding the tender application of the petitioner deliberately issued fresh tender notice which gave cause to the petitioner to approach this Court by way of instant writ petition.
