prayed for time to argue the matter. Time was granted but still the counsel was not prepared to make submissions. Case was fixed for 27.12.2006, when Surinder Kumar appeared in person and informed the Assistant Collector 2nd Grade that his counsel would not available that day. Assistant Collector 2nd Grade accordingly viewed that the petitioners were not interested in the decision of the case and had resorted to adopting delaying tactics. He accordingly made spot inspection and went through Naksha Be'. The plea of the petitioners only was that Kuldip Singh, who was impleaded as a respondent in place of Mam Chand, should be given separate Kura. In addition, the petitioners raised objection that khasra Nos. 40//21, 18, 17, 16 are correct in the northern side, but those have been shown wrongly in the Naksha and the possession of these numbers had been disturbed. They claimed possession of Khasra No.21, 20 and 11 which had not been shown. Assistant Collector did not find any force in the plea for giving separate Kura to Kuldip Singh because when Naksha was prepared, Mam Chand was owner of this land. He also found that Khasra No.40//21 was not included in the land under partition. Assistant Collector also noticed that path has been provided in khasra No.18 as per necessity. It is also noticed that the possession had been disturbed in order to make adjustment of the land under partition. He accordingly rejected all the objections these being without any force and baseless and approved Naksha Be'. Naksha `Zim' was accordingly summoned.
