The present petition has been filed under Section 482 of the Code of Criminal Procedure for quashing of the complaint No. 357 dated 02.11.2007, titled 'Gagandeep Singh Versus Rajiv Parashar and another', under Section 138 of the Negotiable Instruments Act, pending in the court of learned Chief Judicial Magistrate, Kurukshetra, and the summoning order dated 31.01.2008, and all consequential proceedings arising therefrom.

The above said petition came up for hearing before this court on 03.02.2012, on that day the case was

adjourned to 22.02.2012 at the request of learned counsel for the petitioner. On the adjourned date, the case was further adjourned at the request of proxy counsel for 02.07.2012. No one had put in appearance for the petitioner on 02.07.2012, therefore, the case was adjourned to 03.09.2012. On the adjourned date, learned counsel prayed for time to place on record the zimini orders passed by the learned trial court, therefore, the matter was adjourned to 01.10.2012. On the adjourned date, the case was further adjourned to 11.10.2012. On 11.10.2012, request was made for adjournment then this court imposed the costs of `5000/- and adjourned the case for today. Now the written request has been circulated for adjournment, by the learned counsel for the petitioner.

At this stage, Mr.Sudhir Kumar, Advocate, has put in appearance for the petitioner and prays for withdrawal of the present petition. His statement in that regard has been recorded separately.
