This is a petition for grant of regular bail to the petitioner, Gurvinder Singh who has been booked for having committed the offence punishable under Sections 306 read with Section 34 IPC.

Brief facts of the case are that the petitioner is brother-in-law (Devar) of Kulwinder Kaur (since deceased) who was allegedly abetted by the petitioner and his co-accused to commit suicide. The petitioner, his mother and elder brother (husband of the deceased) have already been arrested and are presently behind bars.

law was residing separately from the deceased and her husband. He further submits that he had no interference in the matrimonial life of his brother and sister-in-law. He also submits that the petitioner is behind bars from 21.05.2012 and the trial of the case would take sufficient time to conclude, therefore, his further incarceration is not worth. He further submits that the petitioner is a student and his retention behind bars would spoil his career.

Learned State counsel has opposed the prayer made by learned counsel for the petitioner.

Petitioner is brother-in-law (Devar) of Kulwinder Kaur (since deceased). He is behind bars from 21.05.2012. The examination-in-chief and part cross-examination of the complainant has already been recorded. The mother and elder brother of the petitioner are also behind bars. The petitioner is a student and his further incarceration in the present case is not worth since the trial would take sufficient time to conclude.

Without commenting much on the merits of the case and taking into consideration the factual aspects, the present application is allowed. The petitioner, Gurvinder Singh son of Mohinder Singh, resident of Village Kabulpur, Tehsil Rajpur, District Patiala, is ordered to be released on bail during the pendency of the trial subject to his furnishing bail bonds to the satisfaction of the learned trial Court.
