This petition under Section 439 Cr.P.C. is for grant of regular bail during the pendency of the trial in case FIR No.72 dated 05.11.2011, registered under Sections 308, 323, 325, 34 of the Indian Penal Code, (Section 308 IPC added later on) at Police Station Dorangla, District Gurdaspur.

The learned counsel for the petitioner contends that the petitioner has been falsely implicated. The doctor declared the injury suffered by the complainant under Section 325 IPC, however, on the opinion given by Deputy D.A. (Legal), offence under Section 308 IPC

has been made out. The statement of the complainant has been record. The petitioner is in custody since 02.01.2012.

On the other hand, the learned State counsel has opposed

the prayer.

The petitioner is in custody since 02.01.2012. The trial is not likely to be concluded in the near future. Therefore, no purpose would be achieved by keeping the petitioner in further incarceration.

Accordingly, without adverting to the merits of the case, the present petition is allowed. The petitioner be admitted to bail during the pendency of the trial subject to their furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Gurdaspur.
