The present petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No.465, dated 15.11.2009, under Sections 399, 402, 484, 419, 420, 468, 471, 120-B IPC, Section 25 of the Arms Act and Section 12 of the Passport Act, registered at Police Station Kharar, District SAS Nagar (Mohali).

I have heard learned counsel for the petitioner and have gone through the whole record carefully, including the impugned order passed by learned Additional Sessions Judge, Mohali, vide which application filed on behalf of the present petitioner for anticipatory bail was dismissed.

Brief allegations against petitioner-accused are that co-accused Rabbi Dass, Baljinder Singh, Jasbir Singh, Kamaljit Singh and Divesh were arrested by the police while they were allegedly making preparation to

commit dacoity. However, during investigation, one passport issued in the name of present petitioner was recovered. The said passport was having photograph of Ravinder Singh, who is a hardened criminal, as he is facing several criminal proceedings. There was a conspiracy to get Ravinder Singh freed from the jail and thereafter to send him abroad and hence, a fake passport was got prepared in the name of present petitioner, though with photograph of Ravinder Singh-accused.

It has been vehemently contended by learned counsel for the petitioner that nothing has come on record to show that petitioner is having role in issuance of passport in question.

However, case is at the initial stage of investigation. There are serious allegations against petitioner-accused. Passport was issued in his name though with a photograph of Ravinder Singh, who was undergoing sentence in Central Jail, Ludhiana. It has come during investigation that Ravinder Singh is facing criminal proceedings in number of cases.

Hence, in view of the these facts, it is not such a case in which extraordinary relief of anticipatory bail should be granted to the petitioneraccused.

Without expressing any opinion on the merits of the case, the present petition filed by petitioner-Pardeep Kumar for grant of anticipatory bail is, hereby, dismissed being devoid of any merit.
