Civil Writ Petition No. 14811 of 2009 filed by the petitioner was disposed of on 28.01.2011 in terms of the order dated 23.12.2010 passed in CWP No. 8703 of 2009.
Alleging non-compliance of the afore-stated order, these contempt proceedings have been initiated.
The third respondent has filed reply/affidavit pointing out that in LPA No. 640 of 2011, operation of the impugned judgment, in terms whereof the petitioner's writ petition was disposed of, has been stayed. It is also pointed out that a separate LPA No. 1121 of 2011 has been filed in the petitioner's case also which has been ordered to be taken up along with the afore-stated LPA in the main case.
That being the state of affairs, these contempt proceedings are disposed of at this stage with liberty to the petitioner to seek revival of the same after the decision of the LPA, if so required.
