lost upto the Appellate Authority. Gurmail Singh thereafter approached this Court in CWP No.12507 of 2010 which was dismissed on 09.11.2010. Gurmail Singh thereafter preferred LPA No.1117 of 2011 which was also dismissed by a Division Bench of this Court vide a detailed order dated 05.07.2011.
(3). The petitioner now claims that in fact a partition had already taken place within the family and the land in question had fallen to his share. The above-stated plea was neither here nor there in the previous round of litigation nor it has any bearing on the question as to whether the land in dispute is owned by the Gram Panchayat or by the proprietors.
