The present writ petition has been filed under Article 226 of the Constitution of India praying that Kiran, daughter of the petitioner, be got released from the custody of respondent No.4-Sunny.

In response thereto, learned counsel for the State has filed reply, on behalf of respondents No.1 to 3, by way of affidavit of Jagdish Kumar, Deputy Superintendent of Police (City), Fatehabad and the same is taken on record. It is stated therein that Kiran, daughter of the petitioner, had performed marriage, according to her own accord, with respondent No.4-Sunny. Furthermore, the alleged detenue along with respondent No.4 had filed Criminal Misc. No. M-34492 of 2011 in Court

seeking protection to their lives and liberty from the hands of the petitioner. In the petition, so filed, Kiran had asserted that she is major and there is no impediment in their marriage.

Learned counsel for the State, on instructions from Mahender Singh, Assistant Sub Inspector, Police Station City, Fatehabad, has submitted that Kiran, under the orders passed by the Court of Area Judicial Magistrate, has been sent to Nari Niketan, Karnal. He has further submitted that the case is now fixed tomorrow in the Court of Area Judicial Magistrate for production of Kiran, wife of respondent No.4.

In view of the statement made by learned counsel for the State, no further directions are called for and the present writ petition is disposed of. However, petitioner, if so advised, may approach the Court of Area Judicial Magistrate, for redressal of his grievance, if any, subsists.
