The present writ petition was registered on the basis of a telegram received from Malkeet Singh son of Bir Singh. It is stated therein that Butta Singh son of Khanda Singh and Iqbal Singh son of Balwinder Singh, both residents of village Bhodiya, Tehsil Phillaur, District Jalandhar, were taken into custody by Surinder Singh, Assistant Sub Inspector, Police Station Ladduwal, who has also demanded a sum of ` 50,000 as bribe.
Jasdev Singh Sidhu, Additional Deputy Commissioner of Police (3), Ludhiana, has filed reply by way of his affidavit stating that the petitioner along with his brother are habitual offenders and have been named as accused in various cases pertaining to the offences under the Narcotic Drugs and Psychotropic Substances Act, 1985. was further stated in the affidavit, as under:-
“5. That the said Buta Singh and Iqbal Singh are living in their houses and neither in the custody of the police nor lifted by the police as alleged in the telegram”.
Nobody is present to controvert the assertion made in the affidavit. Hence, no directions, as prayed for, can be issued and the present writ petition is hereby dismissed.
