This petition under Article 226 of the Constitution of India for issuance of a writ in the nature of Habeas Corpus for the release of the detenues mentioned in Para 6 of the petition from the illegal and unlawful custody of respondent No. 5.
Vide order dated 07.12.2009, District Magistrate, Jind was directed to visit the premises of respondent No.5 and ascertain whether the persons mentioned in para 6 of the petition are in illegal detention at the said brick kiln and if so, they shall be got released and submit a report.
The report of the District Magistrate, Jind is on the file and as per the said report the alleged detenues were found at the brick kiln of respondent No.5 but they were never detained by the owner of the brick kiln and now they were not interested to work there and want to go back to their village. Thereafter the labourers alongwith their belongings have been sent to their respective villages.
In view of the said report, the present petition has become infructuous and is dismissed.
