Investigation report by way of short affidavit of Jaswant Singh, S.I., Economic Offences Wing Jalandhar City has been filed in Court today and the same is taken on record.
Learned counsel for the respondent-State on the basis of investigation report submits that a written complaint was made by the petitioner and FIR No. 34 dated 23.1.2009 under Sections 420,468,471,511,120-B IPC was registered at Police Station Division No.4, Jalandhar against Satvir Kaur, Gurmeet Kaur, Bahadur Singh and Pritam Singh. The investigation of the case was conducted by Inspector Kulwant Singh, Economic Offences Wing, Jalandhar and after completion of the investigation, final report under Section 173 Cr.P.C. was prepared and was presented before the Court on 29.7.2010 against accused Resham Singh, Gurmeet Kaur and Jagtar Singh. further submits that accused-Dara Singh had died and subsequently accused Rakesh Kumar was arrested on 2.9.2010 and now he is on bail. He also submits that in this case, inquiry was also conducted by Additional Deputy Commissioner of Police, Headquarter Jalandhar against the role of Satvir Kaur, Bahadur Singh and Pritam Singh, who found them guilty of the offences. Raids were conducted to arrest them but accused-Satvir Kaur and Bahadur Singh were found to be away to Canada and Pritam Singh knowingly escaped from his village. The Chief Judicial Magistrate, Jalandhar had issued warrant of arrest for accused Satvir Kaur, Pritam Singh and Bahadur Singh for 17.2.2011 and on 17.2.2011 proclamation order of the accused has been issued for 26.3.2011.
In view of the submissions made by learned counsel for the respondent-State, no further direction is required to be issued in this petition. The present petition has become infructuous and the same is dismissed as such.
