This is a petition for regular bail pending trial under Section 439 of the Code of Criminal Procedure, 1973 (for short,'Cr.P.C.') in a case registered vide FIR No. 122 dated 05.5.2011, under Sections 420/342 IPC and 15 of the Indian Medical Council Act, 1956 at Police Station Kotwali, District Faridkot.

Learned counsel for the petitioner submits that he is running a De-addiction Centre without proper authorization. Learned counsel further submits that Section 342 IPC and 15 of the Indian Medical Council Act, 1956 are bailable offences, whereas Section 420 IPC is non-bailable and he is in custody for the last three months. for the respondent submits that as per his information received from HC Paramjit Singh, he (petitioner) is neither a previous convict nor any other case is pending against him.

After hearing the learned counsel for the parties and taking into consideration the facts and circumstances of the case, without making any observations on the merit, the present petition is allowed and the petitioner is directed to be released on bail on his furnishing bail bonds to the satisfaction of the learned trial Court.
