Petitioners seek the concession of regular bail in a case registered at the instance of Rajesh Kumar alleging that on account of dispute between complainant and petitioner No.1- Hardayal Singh regarding accounts of sale and purchase of vehicles, the matter was compromised but again on February 7, 2011, while the complainant was sitting in his shop, the petitioners alongwith others armed with weapons assaulted the complainant.

So far as petitioner No.1- Hardayal is concerned, he gave a sword blow on the head of the complainant resulting in an injury dangerous to life. Petitioner No.2 is alleged to have inflicted two blows with gandasi on the head of complainant. Both the petitioners have been in custody w.e.f March 17, 2011. The injury attributed to petitioner No.2 is simple injury.

Taking into consideration the period of detention suffered by petitioner No.2 and the nature of the injury attributed to him, the petition qua petitioner No.2 Amandeep is allowed. Petitioner No.2- Amandeep is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial Court.

Counsel for the petitioners submits that he does not press the petition for petitioner No.1-Hardayal Singh at this stage and has sought permission to withdrawn the same with liberty to file fresh petition after the recording of statement of some witnesses.
