The petitioner, on the basis of an affidavit, submitted with the Electricity Department applied for getting the tubewell connection transferred in her name on the land, which she has purchased. The complainant is also a purchaser of 17 kanals of land out of jointly owned 51 kanals. A criminal case stands registered against the complainant and his son on the allegation that he had assaulted the brother of the petitioner with an intention to kill him. The petitioner is an old lady, having joined the investigation, can be granted the concession of pre-arrest bail as no recovery is to be effected.
Without expression of any opinion on merits, the petition is allowed and interim order dated 7.6.2011 is made absolute subject to all the provisions u/s 438(2) Cr.P.C.
