The petitioner seeks grant of anticipatory bail in case FIR No.80, dated 19.4.2011, registered under Sections 365/34 of the IPC, at Police Station City Ferozepur.
On 18.7.2011, the following contention was noticed :-
“ Learned counsel states that the bail petition of the co-accused who was the passenger has been allowed by this Court by order dated 27.5.2011 passed in Crl. M No.13993 of 2011 and states that in that case one of the factor which has found favour with the Court was that the said Jasvir Singh had returned to Punjab. The present petitioner is the owner of the vehicle and as per document Annexure P-3 the SSP has, in a reply filed in this Court in Crl.M No.25060 of 2010 mentioned the same facts.”
Counsel for the respondent, on instructions from ASI Baljit Singh, has accepted this factual assertion.
In the circumstances, I deem it appropriate to grant the concession of anticipatory bail to the petitioner. Consequently, the petitioner is directed to appear before the Investigating Officer on 12.8.2011 and in the event of his arrest, he shall be released on anticipatory bail by the Investigating Officer to his satisfaction subject to the conditions as laid down in Section 438(2) of the Cr.P.C.
Petition stands disposed of.
