This is a petition under Section 438 Cr.P.C. seeking prearrest bail in a complaint case pending in the court of Judicial Magistrate Ist Class, Jalandhar, wherein the petitioner has been summoned under Sections 376, 366, 120-B and 498-A IPC.

Learned counsel for the petitioner submits that pursuant to order dated April 28, 2011, the petitioner appeared before the Judicial Magistrate Ist Class and furnished bail bonds. He seeks to place on record a certified copy of the order passed by the said court. This prayer is accepted. The order is taken on record as Mark 'A'.

Learned State counsel submits that it being a complaint case, the investigating agency does not require the petitioner for custodial interrogation. The prayer for pre-arrest bail has, however, been opposed by the State counsel.

In view of the fact that pursuant to ad-interim pre-arrest

bail, granted by this court, the petitioner has already surrendered before the trial court and furnished bail bonds, the said order dated April 28, 2011 is hereby made absolute, subject to the conditions as envisaged under Section 438 (2) Cr.P.C.

The petition stands allowed in aforesaid terms.
