This is a petition for cancellation of bail to respondents No. 3 to 5 granted by learned Additional Sessions Judge, Patiala in BA No. 53 of 14.3.2011, decided on 30.3.2011 in FIR No. 59 dated 5.3.2011, under Sections 380, 420, 467, 468, 471, 120-B IPC, registered at Police Station Patran, District Patiala.
Learned counsel has argued that the petitioner had got married for the second time after taking the consent of his first barren wife. Thereafter when he was away to Hardwar she along with her brother and some other persons forcibly entered his house and committed theft. As per learned counsel in such a case the grant of anticipatory bail by the learned Additional Sessions Judge was illegal. Learned Additional Sessions Judge has noticed that there is a dispute between the petitioner and his first wife. He had alleged that she was turned out of the house on the account that she was not ready to give divorce to the petitioner.
In my opinion the order is a well reasoned order. No ground for cancellation of bail is made out.
Dismissed.
