The main allegation is against the petitioner's brother Sukhdev Singh, who had allegedly stolen money from the house of complainant Sham Lal. The petitioner along with others was allegedly standing out side the house at the time of alleged theft. It is alleged that the petitioner had received stolen foreign currency notes from the main accused Sukhdev Singh.
In view of the fact that the only evidence against the petitioner is the disclosure statement of his brother Sukhdev Singh, it will certainly be a moot point during trial whether the said statement of an accomplice would be admissible to seek the conviction of the petitioner.
