Petitioner is the wife of Balwinder Singh. She claims that respondent No.4 had been leveling allegations against her after his return from foreign country on December 13, 2009. The petitioner has filed a suit for maintenance against respondent No.4 alongwith prayer for seeking to create a charge of his property. On the other hand, respondent No.4husband Balwinder Singh seems to have filed an application under Section 9 of the Hindu Marriage Act for restitution of conjugal rights.

Through instant petition, the petitioner seeks a direction to the State authorities to protect the life and liberty of the petitioner as she apprehends threat to her life at the hands of her husband. Annexure P-4 dated March 10, 2010 is stated to be application submitted before DSP, Phillaur, for necessary action.

On the asking of the Court, Mr.Abhishekh Chautala, AAG, Punjab, accepts notice.

After going through the complaint annexure P-4 and without expression of any opinion whether any cognizable offence is made out or not, this petition is disposed of with a direction that in case there is genuine threat to the life of the petitioner, it will be open to her to approach DSP, Phillaur, or Police Commissioner, Jalandhar. In case the allegations are found to be correct or any cognizable offence is established to have been committed by Balwinder Singh- respondent No.4, it will be open to the State authorities to take any action against him in accordance with law. It will also be open to the said authorities to file a complaint in case it is found to be without any basis or found to be misconceived.
