This is a petition under Section 438 Cr.P.C. seeking prearrest bail in a case registered against the petitioner under Section 307/34 IPC and subsequently added Section 326 IPC at Police Station Salem Tabri, District Ludhiana, vide FIR No.96 dated 17th May, 2006.
After arguing at some length, learned counsel for the petitioner submits that he may be allowed to withdraw the present petition with liberty to the petitioner to surrender before the trial court and seek regular bail. He also contends that petitioner shall furnish an undertaking before the trial court that he shall not absent from the proceedings on any date in future.
In view of the statement made by learned counsel for the petitioner, this petition is dismissed as withdrawn with liberty as aforesaid. In case the petitioner appears before the trial court within a

week from today and applies for regular bail, his plea shall be decided within a week thereafter. Arrest of the petitioner shall remain stayed till decision of his bail application.
