This is a petition under Section 438 of the Code of Criminal Procedure seeking anticipatory bail in a case registered against the petitioner vide FIR No.150 dated 8.6.2010 under section 379 IPC at police station Sadar Sirsa.
Learned State counsel (on instructions from ASIBanwari Lal, who is present in court) submits that pursuant to order dated 10.11.2010, the petitioner has already joined investigation and a car and four cell phones, which are referred to in FIR, have been recovered by the investigating agency. Learned State counsel further submits that petitioner is no longer required for custodial interrogation.
In view of the statement made by learned State counsel, the interim order dated 18.10.2010 is hereby made absolute subject to the conditions as envisaged under Section 438 (2) Cr.P.C.
