This is a petition filed under Section 439 of the Code of Criminal Procedure seeking regular bail in a case registered against the petitioner vide FIR No. 64 dated 21.02.2006 under Sections 384, 341, 364A/34 IPC at Police Station City Barnala.

Learned counsel for the petitioner submits that petitioner was declared a proclaimed offender as he could not appear before the court on 12.10.2009. He submits that petitioner was arrested on 01.06.2010 and since then he is in custody. According to learned counsel, petitioner is suffering from some psychiatric problem for which he is undergoing continuous treatment. He has referred to Annexure P-1 (colly) in support of his contention.

Learned State counsel has opposed the prayer for bail on the ground that allegations against the petitioner are serious in nature and he absconded from the court and thereafter arrested by the police.

I have heard learned counsel for the parties.

It appears that petitioner has been in custody for more than six

months now and trial is still at the stage of recording prosecution evidence. Under the circumstances, I am of the considered view that no useful purpose would be served by detaining the petitioner any longer. Without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner. Accordingly, the petition is allowed and petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Barnala. This, however, will be subject to heavy surety and/or any such condition which the trial court may deem fit to impose.
