Tarandeep Singh Vs State of Punjab

This petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail in case FIR No. 59 dated 16.3.2008, under Sections 420, 467, 468, 471, 120-B of the Indian Penal Code registered at Police Station Sadar Ludhiana District Ludhiana.

Learned counsel for the petitioner has submitted that coaccused Kulwant Kaur and Moondeep Singh have since been allowed bail. Kulwant Kaur was the borrower, whereas, the petitioner is a guarantor. The petitioner is in custody since 2.10.2009. Challan has already been presented in this case and the petitioner is not required for further investigation.

Learned State counsel, on the other hand, has opposed this petition.

Keeping in view the fact that the petitioner is in custody since 2.10.2009 and his co-accused have since been allowed bail, it would be just and expedient to release the petitioner on bail.

Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. The petitioner is ordered to be admitted to bail subject to the satisfaction of Chief Judicial Magistrate/ Duty Magistrate Ludhiana.
