The petitioner, who has retired as Assistant Engineer on 30.6.2006 from the services of UHBVN, Jind, has filed the instant petition for quashing the order dated 31.7.2007 (Annexure P9), whereby the benefit of grant of Time Scale to the petitioner on the post of Assistant Engineer on completion of five years of service from April, 1992 to April, 1997 has been denied on the ground that a criminal case was pending against him.
On April 30, 2009, counsel for the petitioner stated that in the said criminal case, the petitioner was acquitted and even the charge sheet issued by the department was also dropped. Copy of the judgment of acquittal was handed over to the counsel for the respondents, who sought time to verify this fact.
Today, Mr. Parveen Gupta, learned counsel for the respondents informs that the matter has been re-considered and the petitioner has been

granted the Time Scale on the post of Assistant Engineer on completion of five years of service from April, 1992 to April, 1997 as well as on completion of twelve years of service from 11.10.1998 to 11.10.2005. He has placed on record a copy of the order dated 13.8.2009 passed by the respondent authorities. He further states that necessary benefit of Time Scale will be released to the petitioner within a period of three months.
In view of the above fact, this petition has become infructuous
and the same is dismissed as such.
