The petitioner, who retired as Executive-II from the office of Punjab Agro Industries Corporation Ltd., Chandigarh, on attaining the age of superannuation on 31.3.2009, has filed the instant petition under Articles 226/227 of the Constitution of India for issuing direction to the respondents to release his retiral benefits i.e. gratuity and leave encashment, which have not been released so far.
Learned counsel for the petitioner states that on the basis of the pendency of one charge sheet, the retiral benefits have not been released to the petitioner on his retirement. It is conceded position that the said charge sheet has not been decided till date.
In view of the said fact, learned counsel for the petitioner states that the petitioner may be permitted to withdraw this petition with liberty to make representation to the respondents to decide the said charge sheet expeditiously.

Dismissed as withdrawn with the aforesaid liberty. However, if the petitioner files the said representation
within one month, respondent No.3 is directed to consider and decide the same expeditiously, preferably within a period of two months in accordance with law.
