Karam Chand Vs State of Haryana and Ors.

The father of the petitioner was working as Beldar in the Municipal Council, Karnal. He expired on 12.10.2005 after serving about 27 years. Counsel for the petitioner states that the father of the petitioner was regular employee of the Municipal Council.

It is the case of the petitioner that after the death of his father, the petitioner is entitled for ex-gratia compassionate appointment or the exgratia compassionate financial assistance as per Haryana Government Employees Rules, 2006. It is further the case of the petitioner that in spite of the fact that he had applied for the same, the said benefit has not been granted to him. In this regard the petitioner has served a legal notice dated 13.8.2008 (Annexure P3) upon respondent No.2. It is the case of the petitioner that till date the said respondent has not taken any decision on the said legal notice under the aforesaid Rules.

In view of these facts, without issuing notice to the other side as it will unnecessary delay the matter, this petition is disposed of with a direction to respondent No.2 to consider and decide the said legal notice expeditiously, preferably within a period of three months, in accordance with law.
