Tabir-Ul-Haq Vs State of Punjab

The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.290 dated 26.8.2006 registered under Sections 419, 420, 465, 467, 468, 471 and 120-B IPC at Police Station City Batala, District Gurdaspur.

Earlier in Crl.Misc.No.63294-M of 2006, the petitioner was granted anticipatory bail by this Court in the aforesaid case under Sections 419, 420, 465, 467, 471 and 120-B IPC. Subsequently, the police submitted the challan in the said FIR against the petitioner for the offence under Section 468 IPC also. Since for the offence under Section 468 IPC challan was also presented in the trial Court, in which anticipatory bail was not granted by this Court, the petitioner filed the instant petition for grant of anticipatory bail under the said Section also. This Court vide order dated May 29, 2009 issued notice of motion with the direction that the petitioner may appear before the trial Court within a period of three weeks and furnish his regular bail bonds to its satisfaction. In view of the aforesaid facts, the interim order dated May 29, 2009 is made absolute.
