This petition has been moved by Jai Pal alias Pali, under Section 482 of Cr.P.C., seeking emergency parole for four weeks to look after his wife who is suffering from D.U.B. With bulky uterus and excessive bleeding and has to undergo surgery.
Reply filed by State is taken on record.
I have heard the counsels for the parties, besides perusing the record with due care and circumspection.
This petition is disposed of with a direction to the respondents that the petitioner shall be released on parole for a period of two weeks from the date of his release, subject to the satisfaction of District Magistrate, Fatehgarh Sahib, who shall take an adequate surety before releasing him under the rules. After expiry of the abovesaid parole period, the petitioner shall surrender before the Superintendent, Central Jail, Patiala-Respondent No.2.
